I Purpose, scope and definitions

This Notice describes the intellectual-property practices of NintendoProject.com (the "Platform"), an independent, documentary, educational and cultural website devoted to the history of video games, their hardware, their creators and their cultural impact. Its purpose is to explain the framework under which the Platform operates, the limits of its activity, and the formal channels available to rightsholders.

The Platform is an editorial project: its published content is written and produced by the Platform's own authors. The Platform does not operate as a general-purpose host for content uploaded by third parties.

For the purposes of this Notice, the following terms shall have the meaning indicated:

  • "Nintendo" jointly refers to Nintendo Co., Ltd., Nintendo of America Inc., Nintendo of Europe SE/GmbH and any of their affiliates, subsidiaries, successors or licensees.
  • "Protected works" means any work or subject matter protected by copyright or related rights, including video games, software, firmware, audiovisual works, music, artwork, manuals and packaging.
  • "Third-party content" means any material embedded from external services or linked from external sources not controlled by the Platform.
  • "User" means any person who browses the Platform.

Headings are included for convenience only and shall not affect the interpretation of this Notice. Where a term is defined by applicable law, the statutory definition shall prevail.

II Legal framework: DMCA and EU/Spanish law

As an editorial publisher, the Platform's editorial content is original work of its authors or material used under an applicable exception or licence. To the extent the Platform ever transmits, caches, links to or embeds material provided by third parties, it relies, where applicable, on the safe-harbor limitations of liability for intermediary service providers under the United States Digital Millennium Copyright Act (17 U.S.C. § 512). In particular, in respect of any such third-party material, the Platform: (a) does not have actual knowledge of infringing material and, upon obtaining such knowledge or awareness, acts expeditiously to remove or disable access to it; (b) does not receive a financial benefit directly attributable to allegedly infringing activity that it has the right and ability to control; and (c) has designated an agent to receive notifications of claimed infringement.

As a provider established in the European area, the Platform also operates in accordance with:

  • Regulation (EU) 2022/2065 (Digital Services Act, "DSA"), in particular Articles 4–6 on liability exemptions for mere-conduit, caching and hosting providers, and Article 8, which confirms that intermediaries are under no general obligation to monitor the information they transmit or store.
  • Spanish Act 34/2002 (LSSI-CE), Articles 16 and 17, on the liability of hosting providers and of providers of links and search tools, which condition liability on effective knowledge of unlawfulness and lack of diligent reaction.
  • Royal Legislative Decree 1/1996 (Spanish Copyright Act, TRLPI), including its rules on exceptions and limitations, and Directive (EU) 2019/790 on copyright in the Digital Single Market.

The Platform cooperates in good faith with rightsholders and is willing to consider reasonable and proportionate measures, agreed on a case-by-case basis, to address any infringing use connected to its services. Nothing in this Notice shall be construed as a waiver of any defence, exception or limitation available to the Platform under any applicable law.

III Designated agent and processing of notices

The Platform maintains a single, permanently available point of contact for intellectual-property notices. The Platform's designated agent has been registered with the United States Copyright Office pursuant to 17 U.S.C. § 512(c)(2), and the Platform likewise maintains a point of contact for the purposes of Article 16.1(b) LSSI-CE:

Indicative response time: valid notices are processed expeditiously upon receipt, typically within 24 to 72 hours.

Upon receipt of a notice, the Platform will follow this procedure: (1) acknowledgment of receipt to the complaining party; (2) formal review of the notice against the statutory requirements set out in Section VII; (3) where the notice is valid, expeditious removal of, or disabling of access to, the identified material; and (4) retention of an internal record of the notice and of the measures adopted, for evidentiary and compliance purposes.

Notices that are materially incomplete will not be rejected outright where the defect can be cured: the Platform may inform the complaining party of the missing elements and grant a reasonable period to correct them. The same channel may be used for trademark complaints and for any other intellectual-property communication, which will be handled under the corresponding legal regime.

IV Declaration of non-distribution of protected works

The Platform does not host, reproduce, distribute, publicly communicate or make available video games, ROMs, ISOs, firmware, BIOS files, memory dumps, decryption or cryptographic keys, save files containing protected code, emulator configurations bundled with protected works, or any other protected work owned by Nintendo. The Platform likewise does not provide, promote or link to tools, devices or services whose principal purpose is the circumvention of technological protection measures (17 U.S.C. § 1201; Article 160 TRLPI).

The Platform does not operate as a download repository, index of downloads or file-locker directory, and does not derive economic benefit directly attributable to the availability of digital copies of Nintendo products.

Where the Platform contains links to external websites, such links are provided for documentary reference only, do not imply endorsement of the linked content, and remain outside the Platform's control. In accordance with Article 17 LSSI-CE, the Platform will remove or disable any link upon obtaining effective knowledge, through a valid notice, that the linked content is unlawful or infringes third-party rights.

Any editorial content published on the Platform — articles, chronologies, technical analyses, interviews and photographs of physical items lawfully owned by their contributors — constitutes original work of its authors or material used under an applicable exception or licence.

V References to trademarks and right of quotation

Any reference to trademarks, trade names, console names, game titles, characters' names, technologies or formats owned by Nintendo is made solely for descriptive, historical, technical, educational and informational purposes. The Platform understands that such references fall within the doctrine of nominative fair use under US law — where the products discussed cannot reasonably be identified without using the marks, the marks are used only to the extent necessary for identification, and nothing in the use suggests sponsorship or endorsement by the trademark owner — and the Platform endeavours to act in accordance with that doctrine.

In the European and Spanish sphere, the Platform relies on Article 14 of Regulation (EU) 2017/1001 on the European Union trade mark and on Article 37 of the Spanish Trademark Act 17/2001, which permit the use of a mark to identify or refer to the proprietor's goods or services where such use is made in accordance with honest practices in industrial and commercial matters. The right of quotation of Article 32 TRLPI additionally covers the inclusion of fragments of works for purposes of analysis, commentary or critical assessment, to the extent justified by such purposes.

The Platform does not use Nintendo's official logos as its own branding and does not imitate Nintendo's trade dress in a manner liable to cause confusion. This site is an independent, unofficial archive and is not affiliated with, sponsored, endorsed or authorized in any way by Nintendo. References to Nintendo's marks do not imply sponsorship, authorization, licence, affiliation or any commercial relationship. Nintendo Switch, Nintendo and all other names mentioned are registered trademarks of their respective owners.

VI Documentary treatment of discontinued works

Video games are a form of cultural heritage. A substantial part of the medium's history is tied to systems, media and distribution channels that no longer exist, and to works that have been discontinued, delisted or rendered inaccessible by hardware obsolescence. The Platform's documentary activity in relation to such works consists of study, cataloguing and commentary.

This activity relies on freedom of expression, the right to information and the right of quotation (Article 32 TRLPI), and, where applicable under US law, on the doctrine of fair use, applied to cataloguing, technical analysis and historical commentary. The Platform's documentary work refers strictly to metadata, articles, screenshots and technical analysis, and never to the hosting or distribution of playable files, even for discontinued works.

Where the Platform quotes fragments of protected works, that use is intended to satisfy the three-step test that limits such exceptions (Article 40 bis TRLPI; Article 5(5) of Directive 2001/29/EC): it is confined to specific documentary purposes, does not conflict with the normal commercial exploitation of Nintendo products currently available on the market, and does not unreasonably prejudice the legitimate interests of the rightsholder.

Where a previously discontinued work returns to lawful commercial availability, the Platform will, upon reasoned request by the rightsholder, review the documentary treatment given to that work and adopt the adjustments that are appropriate under the applicable exceptions.

VII Requirements for takedown notices

Any notice concerning an alleged infringement should comply with 17 U.S.C. § 512(c)(3) and include all of the following elements:

  • Individualized identification of the copyrighted work claimed to be infringed or, if multiple works are covered by a single notice, a representative list of such works.
  • Precise identification of the material claimed to be infringing and requested to be removed, preferably by specific URL, or other information reasonably sufficient to permit the Platform to locate it.
  • Sufficient contact information of the complaining party: name, postal address, telephone number and email address.
  • A statement that the complaining party has a good-faith belief that the use of the material is not authorized by the rightsholder, its agent, or the law. Consistent with US case law on § 512, forming that good-faith belief involves considering whether the use is covered by fair use or another legal authorization.
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that the complaining party is the rightsholder or is authorized to act on its behalf.
  • A physical or electronic signature of the rightsholder or of its authorized representative.

Generic, automated, mass or non-individualized communications — including notices that identify neither a specific work nor a specific location — may not meet these requirements, without prejudice to their later correction under the cure procedure described in Section III. The Platform will treat all personal data received through this channel in accordance with applicable data-protection law and solely for the management of the complaint.

VIII Counter-notification and restoration

Because the Platform is an editorial project and does not host content uploaded by third parties, counter-notifications will rarely apply. This Section applies only to the extent that material provided by a third party (for example, an embedded item) is ever removed following a notice.

In such a case, the affected party may file a counter-notification under 17 U.S.C. § 512(g). To be valid, it must include: the party's physical or electronic signature; identification of the removed material and its prior location; a statement, under penalty of perjury, of good-faith belief that the material was removed as a result of mistake or misidentification; and the party's name, address and telephone number, together with consent to the jurisdiction of the competent federal district court (or, for parties outside the United States, of any judicial district in which the Platform may be found) and acceptance of service of process from the complaining party.

Upon receipt of a valid counter-notification, the Platform will forward it to the original complaining party. Unless the complaining party notifies the Platform, within the statutory period, that it has filed a court action seeking to restrain the allegedly infringing activity, the material may be restored within 10 to 14 business days. The Platform notes that 17 U.S.C. § 512(f) imposes liability on any person who knowingly materially misrepresents that material is infringing or that it was removed by mistake, and will retain records of the notices and counter-notifications it processes.

IX Repeat infringer policy

In accordance with 17 U.S.C. § 512(i), the Platform has adopted and reasonably implements a policy providing for the termination, in appropriate circumstances, of the accounts of repeat infringers. Given that the Platform is editorial and does not host third-party accounts or uploads, this policy operates as a residual safeguard applicable only in the event that third-party contribution is ever enabled.

Should that occur, the Platform would keep an internal record of valid notices associated with each contributor, issue warnings, suspend contribution privileges, and, where the seriousness, frequency and intentionality of the conduct so justify, terminate the corresponding account. Counter-notifications resolved in favour of the contributor would not count against them.

X Governing law, amendments, severability and final declaration

This Notice is construed in accordance with Spanish and European Union law, without prejudice to the application of the DMCA for the purposes of the US safe-harbor regime and of any mandatory rules of other jurisdictions from which the Platform is accessed. Any dispute arising from this Notice shall be submitted to the courts that are competent under the applicable rules, without prejudice to mandatory consumer-protection forums.

The Platform may amend this Notice at any time to reflect legislative, jurisprudential or operational changes. Amendments take effect upon publication on this page, which states the version in force at any given time. Should any clause of this Notice be held invalid or unenforceable, the remaining provisions shall remain in full force, and the invalid clause shall be replaced by a valid one that most closely reflects its purpose.

The Platform declares that its activity is editorial, documentary, cultural and educational in nature; that it does not commercially exploit works owned by Nintendo; that it does not host or distribute protected software; and that it maintains effective notification, review and removal procedures in accordance with the DMCA, the DSA, the LSSI-CE, the TRLPI and the applicable international intellectual-property treaties.

I Objeto, ambito y definiciones

El presente Aviso describe las practicas de propiedad intelectual de NintendoProject.com (en adelante, "la Plataforma"), sitio independiente, documental, divulgativo y cultural dedicado a la historia del videojuego, su hardware, sus creadores y su impacto cultural. Su finalidad es exponer el marco en el que opera la Plataforma, los limites de su actividad y los canales formales a disposicion de los titulares de derechos.

La Plataforma es un proyecto editorial: su contenido publicado esta redactado y producido por sus propios autores. La Plataforma no opera como alojamiento de proposito general para contenidos subidos por terceros.

A efectos de este Aviso, los siguientes terminos tendran el significado que se indica:

  • "Nintendo" designa conjuntamente a Nintendo Co., Ltd., Nintendo of America Inc., Nintendo of Europe SE/GmbH y cualesquiera filiales, subsidiarias, sucesoras o licenciatarias.
  • "Obras protegidas" designa toda obra o prestacion protegida por derechos de autor o derechos afines, incluidos videojuegos, software, firmware, obras audiovisuales, musica, arte, manuales y embalajes.
  • "Contenido de terceros" designa cualquier material incrustado desde servicios externos o enlazado desde fuentes no controladas por la Plataforma.
  • "Usuario" designa a toda persona que navega por la Plataforma.

Los encabezados se incluyen a efectos meramente sistematicos y no condicionan la interpretacion del Aviso. Cuando un termino este definido por la normativa aplicable, prevalecera la definicion legal.

II Marco juridico: DMCA y normativa española y europea

En cuanto editor, el contenido editorial de la Plataforma constituye obra original de sus autores o material utilizado al amparo de una excepcion o licencia aplicable. En la medida en que la Plataforma llegue a transmitir, almacenar en memoria tampon, enlazar o incrustar material aportado por terceros, se acoge, cuando proceda, a los regimenes de limitacion de responsabilidad ("safe harbor") aplicables a prestadores de servicios intermediarios conforme al Digital Millennium Copyright Act de los Estados Unidos (17 U.S.C. § 512). En particular, respecto de cualquier material de terceros, la Plataforma: (a) carece de conocimiento efectivo de material infractor y, cuando lo adquiere, actua con diligencia para retirarlo o inhabilitar su acceso; (b) no percibe un beneficio economico directamente atribuible a una actividad presuntamente infractora que tenga el derecho y la capacidad de controlar; y (c) ha designado un agente para la recepcion de notificaciones de infraccion.

Asimismo, en cuanto prestador establecido en el ambito europeo, opera conforme a:

  • El Reglamento (UE) 2022/2065 (Reglamento de Servicios Digitales, "DSA"), en particular sus arts. 4 a 6 sobre exencion de responsabilidad de intermediarios de mera transmision, memoria tampon y alojamiento, y su art. 8, que confirma la inexistencia de una obligacion general de supervision.
  • La Ley 34/2002 (LSSI-CE), arts. 16 y 17, sobre responsabilidad de prestadores de alojamiento y de enlaces, condicionada al conocimiento efectivo de la ilicitud y a la falta de reaccion diligente.
  • El Real Decreto Legislativo 1/1996 (TRLPI), incluidas sus normas sobre limites y excepciones, y la Directiva (UE) 2019/790 sobre derechos de autor en el mercado unico digital.

La Plataforma colabora de buena fe con los titulares de derechos y esta dispuesta a valorar medidas razonables y proporcionadas, acordadas caso por caso, para atender cualquier uso infractor vinculado a sus servicios. Nada en este Aviso podra interpretarse como renuncia a las defensas, excepciones o limitaciones que asistan a la Plataforma conforme a cualquier normativa aplicable.

III Agente designado y tramitacion de notificaciones

La Plataforma mantiene un punto de contacto unico y permanentemente disponible para notificaciones de propiedad intelectual. Su agente designado se encuentra registrado ante la U.S. Copyright Office de conformidad con 17 U.S.C. § 512(c)(2), y la Plataforma mantiene asimismo un punto de contacto a efectos del art. 16.1.b) LSSI-CE:

Plazo orientativo de respuesta: las notificaciones validas se procesan de forma expedita tras su recepcion, habitualmente en un plazo de 24 a 72 horas.

Recibida una notificacion, la Plataforma seguira el siguiente procedimiento: (1) acuse de recibo al reclamante; (2) examen formal de la notificacion conforme a los requisitos de la Seccion VII; (3) si la notificacion es valida, retirada diligente o inhabilitacion del acceso al material identificado; y (4) conservacion de un registro interno de la notificacion y de las medidas adoptadas, a efectos probatorios y de cumplimiento.

Las notificaciones materialmente incompletas no seran rechazadas de plano cuando el defecto sea subsanable: la Plataforma podra indicar al reclamante los elementos que faltan y conceder un plazo razonable para corregirlos. El mismo canal podra utilizarse para reclamaciones de marcas y para cualquier otra comunicacion de propiedad intelectual, que se tramitara conforme al regimen legal correspondiente.

IV Declaracion de no distribucion de obras protegidas

La Plataforma no aloja, no reproduce, no distribuye, no comunica publicamente ni pone a disposicion videojuegos, ROMs, ISOs, firmware, archivos BIOS, volcados de memoria, claves criptograficas o de descifrado, partidas guardadas que contengan codigo protegido, configuraciones de emuladores empaquetadas con obras protegidas, ni ninguna otra obra o prestacion protegida titularidad de Nintendo. La Plataforma tampoco proporciona, promociona ni enlaza herramientas, dispositivos o servicios cuya finalidad principal sea la elusion de medidas tecnologicas de proteccion (17 U.S.C. § 1201; art. 160 TRLPI).

La Plataforma no opera como repositorio de descargas, indice de descargas ni directorio de servidores de archivos, y no obtiene beneficio economico directamente atribuible a la puesta a disposicion de copias digitales de productos de Nintendo.

Cuando la Plataforma contenga enlaces a sitios externos, dichos enlaces se facilitan con finalidad exclusivamente documental, no implican aprobacion del contenido enlazado y quedan fuera del control de la Plataforma. Conforme al art. 17 LSSI-CE, la Plataforma retirara o inhabilitara cualquier enlace cuando adquiera conocimiento efectivo, mediante notificacion valida, de que el contenido enlazado es ilicito o lesiona derechos de terceros.

El contenido editorial publicado en la Plataforma — articulos, cronologias, analisis tecnicos, entrevistas y fotografias de ejemplares fisicos legitimamente adquiridos por sus colaboradores — constituye obra original de sus autores o material utilizado al amparo de una excepcion o licencia aplicable.

V Menciones a marcas y derecho de cita

Toda mencion a marcas, nombres comerciales, nombres de consolas, titulos de videojuegos, nombres de personajes, tecnologias o formatos titularidad de Nintendo se realiza con finalidad exclusivamente descriptiva, historica, tecnica, educativa e informativa. La Plataforma entiende que dichas menciones encajan en la doctrina del nominative fair use del Derecho estadounidense — cuando los productos comentados no pueden identificarse razonablemente sin emplear las marcas, estas se utilizan solo en la medida necesaria para su identificacion y nada en el uso sugiere patrocinio o aprobacion del titular — y procura actuar conforme a dicha doctrina.

En el ambito europeo y español, la Plataforma se ampara en el art. 14 del Reglamento (UE) 2017/1001 sobre la marca de la Union Europea y en el art. 37 de la Ley 17/2001 de Marcas, que permiten el uso de una marca para identificar o referirse a los productos o servicios de su titular cuando dicho uso sea conforme a las practicas leales en materia industrial y comercial. El derecho de cita del art. 32 TRLPI ampara adicionalmente la inclusion de fragmentos de obras con fines de analisis, comentario o juicio critico, en la medida justificada por dichos fines.

La Plataforma no utiliza los logotipos oficiales de Nintendo como imagen de marca propia y no imita la imagen comercial de Nintendo de forma apta para generar confusion. Este sitio es un archivo independiente, no oficial, y no esta afiliado, patrocinado, respaldado ni autorizado en modo alguno por Nintendo. Las menciones a las marcas de Nintendo no implican patrocinio, autorizacion, licencia, afiliacion ni relacion comercial alguna. Nintendo Switch, Nintendo y demas denominaciones citadas son marcas registradas de sus respectivos titulares.

VI Tratamiento documental de obras descatalogadas

El videojuego es una forma de patrimonio cultural. Una parte sustancial de la historia del medio esta ligada a sistemas, soportes y canales de distribucion que ya no existen, y a obras descatalogadas, retiradas de las tiendas digitales o inaccesibles por obsolescencia del hardware. La actividad documental de la Plataforma respecto de tales obras consiste en su estudio, catalogacion y comentario.

Dicha actividad se ampara en la libertad de expresion, el derecho a la informacion y el derecho de cita (art. 32 TRLPI) y, cuando resulte aplicable el Derecho estadounidense, en la doctrina del fair use, aplicados a la catalogacion, el analisis tecnico y el comentario historico. El trabajo documental de la Plataforma se refiere estrictamente a metadatos, articulos, capturas de pantalla y analisis tecnicos, y nunca al alojamiento o distribucion de archivos jugables, ni siquiera de obras descatalogadas.

Cuando la Plataforma cite fragmentos de obras protegidas, dicho uso pretende satisfacer la regla de los tres pasos que limita tales excepciones (art. 40 bis TRLPI; art. 5.5 de la Directiva 2001/29/CE): se limita a finalidades documentales concretas, no entra en conflicto con la explotacion comercial normal de los productos de Nintendo actualmente disponibles en el mercado y no causa un perjuicio injustificado a los intereses legitimos del titular.

Si una obra anteriormente descatalogada recupera su disponibilidad comercial licita, la Plataforma, previa solicitud motivada del titular, revisara el tratamiento documental dado a dicha obra y adoptara los ajustes que procedan conforme a las excepciones aplicables.

VII Requisitos de las notificaciones de retirada

Toda notificacion relativa a una supuesta infraccion deberia cumplir los requisitos del 17 U.S.C. § 512(c)(3) e incluir todos los elementos siguientes:

  • Identificacion individualizada de la obra protegida presuntamente infringida o, si una sola notificacion abarca varias obras, una lista representativa de dichas obras.
  • Identificacion precisa del material presuntamente infractor cuya retirada se solicita, preferiblemente mediante URL especifica, u otra informacion razonablemente suficiente para permitir su localizacion.
  • Datos de contacto suficientes del reclamante: nombre, direccion postal, telefono y correo electronico.
  • Declaracion de que el reclamante cree de buena fe que el uso del material no esta autorizado por el titular, su agente o la ley. Conforme a la jurisprudencia estadounidense sobre el § 512, la formacion de esa creencia de buena fe exige valorar si el uso queda cubierto por el fair use u otra autorizacion legal.
  • Declaracion, bajo pena de perjurio, de que la informacion de la notificacion es exacta y de que el reclamante es el titular de los derechos o esta autorizado para actuar en su nombre.
  • Firma fisica o electronica del titular o de su representante autorizado.

Las comunicaciones genericas, automatizadas, masivas o carentes de identificacion individualizada — incluidas las que no identifiquen ni una obra concreta ni una ubicacion concreta — podrian no reunir estos requisitos, sin perjuicio de su subsanacion posterior conforme al procedimiento descrito en la Seccion III. La Plataforma tratara los datos personales recibidos a traves de este canal conforme a la normativa de proteccion de datos aplicable y unicamente para la gestion de la reclamacion.

VIII Contranotificacion y restitucion

Dado que la Plataforma es un proyecto editorial y no aloja contenido subido por terceros, la contranotificacion resultara aplicable solo de forma excepcional. Esta Seccion opera unicamente en la medida en que llegue a retirarse, tras una notificacion, material aportado por un tercero (por ejemplo, un elemento incrustado).

En tal caso, la parte afectada podra presentar contranotificacion conforme al 17 U.S.C. § 512(g). Para ser valida, debera incluir: la firma fisica o electronica de la parte; la identificacion del material retirado y de su ubicacion anterior; una declaracion, bajo pena de perjurio, de que cree de buena fe que el material fue retirado por error o identificacion incorrecta; y su nombre, direccion y telefono, junto con la aceptacion de la jurisdiccion del tribunal federal de distrito competente (o, para partes fuera de los Estados Unidos, de cualquier distrito judicial en el que la Plataforma pueda ser hallada) y la aceptacion de la notificacion de demandas por parte del reclamante.

Recibida una contranotificacion valida, la Plataforma la remitira al reclamante original. Salvo que el reclamante comunique a la Plataforma, dentro del plazo legal, que ha interpuesto una accion judicial dirigida a impedir la actividad presuntamente infractora, el material podra ser restituido en un plazo de entre 10 y 14 dias habiles. La Plataforma recuerda que el 17 U.S.C. § 512(f) impone responsabilidad a quien, a sabiendas, efectue declaraciones sustancialmente falsas sobre el caracter infractor de un material o sobre su retirada por error, y conservara registro de las notificaciones y contranotificaciones que tramite.

IX Politica de infractores reincidentes

De conformidad con 17 U.S.C. § 512(i), la Plataforma ha adoptado y aplica de forma razonable una politica que preve la cancelacion, en circunstancias apropiadas, de las cuentas de infractores reincidentes. Dado que la Plataforma es editorial y no aloja cuentas ni subidas de terceros, esta politica opera como salvaguarda residual, aplicable unicamente en caso de que llegue a habilitarse la aportacion de contenido por terceros.

De producirse tal supuesto, la Plataforma mantendria un registro interno de las notificaciones validas asociadas a cada colaborador, emitiria advertencias, suspenderia privilegios de colaboracion y, cuando la gravedad, frecuencia e intencionalidad de la conducta lo justifiquen, cancelaria la cuenta correspondiente. Las contranotificaciones resueltas a favor del colaborador no computarian en su contra.

X Ley aplicable, modificaciones, salvaguarda y declaracion final

Este Aviso se interpreta conforme al Derecho español y de la Union Europea, sin perjuicio de la aplicacion del DMCA a los efectos del regimen de puerto seguro estadounidense y de las normas imperativas de otras jurisdicciones desde las que se acceda a la Plataforma. Toda controversia derivada de este Aviso se sometera a los tribunales que resulten competentes conforme a las normas aplicables, sin perjuicio de los fueros imperativos de proteccion de consumidores.

La Plataforma podra modificar este Aviso en cualquier momento para reflejar cambios legislativos, jurisprudenciales u operativos. Las modificaciones surtiran efecto desde su publicacion en esta pagina, que recoge la version vigente en cada momento. Si alguna clausula de este Aviso fuera declarada nula o inaplicable, las restantes conservaran plena vigencia, y la clausula afectada se sustituira por otra valida que refleje lo mas fielmente posible su finalidad.

La Plataforma declara que su actividad es editorial, documental, cultural y educativa; que no explota comercialmente obras titularidad de Nintendo; que no aloja ni distribuye software protegido; y que mantiene procedimientos efectivos de notificacion, examen y retirada conforme al DMCA, el DSA, la LSSI-CE, el TRLPI y los tratados internacionales de propiedad intelectual que le resultan de aplicacion.
